A1 certificates and EU notifications/ secondment notifications

Do these questions sound familiar to you?

  • What is the difference between a business trip and a posting?
  • What is the difference between an A1 certificate and an EU notification/notification of posting?
  • Do I need an EU notification/notification of posting for short stays in other EU/EFTA countries (e.g. trade fair visits, seminars, meetings)?
  • Do I need an EU declaration/notification of posting if I provide a service (e.g. assembly, maintenance, commissioning of machines, etc.) in another EU/EFTA country?
  • Is an A1 certificate sufficient for my trip?
  • Where can I apply for an A1 certificate or EU notification?

A1 certificate:
The A1 certificate serves as proof that the employee is still covered by social security in their home country during their business trip/assignment abroad.
This prevents double taxation of social security contributions.
The A1 form must be carried regardless of the duration of the stay, the function or the industry when traveling on business to EU/EFTA states and contracting states.

EU notification:
In 2016, the EU member states transposed the defined requirements of the Posting of Workers Directive 96/71/EC and Directive 2014/67/EU into national law.
The aim of this directive is to prevent and combat WAGES and SOCIAL DUMPING.
The EU notification obligations apply to posted workers, so-called "posted workers", whose stay must be reported to the labor authority, the social security authority or the occupational safety authority before deployment, depending on the country, duration, activity and sector. In the destination country, minimum standards such as equal pay, working hours, work break regulations, vacation regulations, etc. must be observed and documented.
Failure to comply with the reporting obligation can lead to significant sanctions and far-reaching consequences for both the sending company and the receiving company.

The ÖVKG supports you in the EU notification process in the following areas:

  • Check whether an EU notification obligation exists
  • Performing the notification, including possible company registration
  • Collection of the documents to be presented
  • Provision of representatives in the destination country
  • Dispatch / provision of the document set of the EU notification

Our innovative and user-friendly online portal allows you to enter orders at any time, view the processing status around the clock and give third parties - e.g. your HR department - access for viewing and/or processing.
